Who we are
CrashPin is operated by PROVIDER_LEGAL_NAME ("we", "us"), a company incorporated in the Hong Kong Special Administrative Region, of PROVIDER_REGISTERED_ADDRESS. How we handle your data is set out separately in our Privacy Policy, which forms part of these terms.
What CrashPin is
CrashPin is a crowdsourced road-incident reporting app. Contributors report crashes they see, validate reports filed by others, and earn points for accepted contributions.
CrashPin is not an emergency service. Filing a report does not summon police, ambulance, fire or any other responder, and no one is dispatched because you reported something. If anyone is hurt or in danger, call 000 (or your local emergency number) first. CrashPin is not a substitute for that call and never will be.
Safety rules
These rules are conditions of using CrashPin. They apply to every report and every validation, whether or not the app reminds you of them at the time. We deliberately do not put a safety checklist between you and the Submit button: an extra screen keeps you beside a live traffic hazard for longer, which is the opposite of what it would claim to achieve. The obligation is on you, continuously, and it is set out here.
Do not use CrashPin while driving
Only interact with the app when it is lawful and safe to do so. Passengers may use it freely. If you are driving, do not use it โ stop somewhere safe and legal first, or do not report at all. In Queensland and every other Australian jurisdiction, handling a mobile phone while driving is an offence, and nothing in this app authorises or excuses it.
Do not approach a crash scene
Never approach vehicles, people or debris in order to report. Observe only from a safe, lawful position. Do not enter a carriageway, cross traffic, stop on a shoulder where stopping is prohibited, or put yourself between traffic and a hazard.
Do not remain at a crash scene
Do not linger, direct traffic, interfere with responders, photograph casualties, solicit work, or wait for a tow. Report and move on. Points are awarded for the report, never for how long you stay or how close you get, and there is no advantage to being at a scene rather than past it.
Do not create the incident you report
Do not cause, stage, exaggerate or fabricate an incident. Do not file a report for a crash you have not observed unless you hold the remote-place capability and are relaying a report from an identified source.
Your account
- One account per person. Do not share, sell or transfer it.
- Keep your contact details accurate โ they are how we reach you about your account, your points and any change to these terms.
- You are responsible for everything filed from your account. If you think someone else has access to it, tell us at support@crashpin.app.
- You can delete your account at any time from the app, or at crashpin.app/delete-account.
Points and rewards
Points recognise accepted contributions. They are not money, not property, and have no cash value. They cannot be bought, sold, transferred between accounts, or redeemed for cash. We may adjust, reverse or void points that were awarded for a contribution later found to be duplicated, fabricated, automated or otherwise in breach of these terms, and we keep a record of every adjustment.
We may in future offer rewards that points can be redeemed for. If we do, redeeming them will be optional, will be subject to separate terms published at that time, and may require us to verify your identity and collect the information needed to meet tax, anti-money-laundering or sanctions obligations. Nothing here obliges us to introduce redeemable rewards or to keep any that we do introduce.
Acceptable use
You must not:
- File reports you know to be false, duplicated to inflate points, or generated by a script, emulator or modified client.
- Use CrashPin to solicit towing, repair or legal work, to follow or harass anyone, or to identify people involved in a crash.
- Reverse engineer, decompile or interfere with the app or our servers, or attempt to defeat device attestation.
- Scrape, resell or redistribute the incident feed without our written permission.
We may suspend or terminate an account that breaches these terms, and may report unlawful conduct to the relevant authority.
Your content
You keep ownership of the reports and photographs you submit. You grant us a worldwide, royalty-free licence to host, reproduce, adapt and publish them for the purpose of operating CrashPin and producing road-safety information, including in aggregated or de-identified form. Reports appear on the public map without your name attached. You confirm you have the right to submit anything you upload, and that photographs you submit do not identify injured people.
Availability and accuracy
CrashPin is provided on an "as is" and "as available" basis. Reports are contributed by members of the public and by third-party feeds. We do not verify every report, and a pin on the map is not confirmation that a crash occurred, is still there, or is as described. Do not rely on CrashPin for navigation, emergency, dispatch or safety-critical decisions. We may change, suspend or discontinue any part of the service.
Liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, for loss of profits or data, or for anything arising from your reliance on a report, from your presence at or near a crash scene, or from your use of the app while driving.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement. Where our liability can be limited but not excluded, it is limited to resupplying the service or paying the cost of doing so.
Changes to these terms
If we make a material change we will update the date and version at the top of this page and notify you in the app before it takes effect. Continuing to use CrashPin after that means you accept the change.
Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction. If you are a consumer, you may also bring proceedings in the courts of the place where you live, and you keep the benefit of any mandatory consumer protection law of that place.
